What Canadian Privacy Law Actually Says<\/b><\/p>\n

Canada\u2019s <\/span>Personal Information Protection and Electronic Documents Act<\/span><\/i> (PIPEDA) doesn\u2019t tie personal data to Canadian soil \u2014 but it <\/span>does<\/span><\/i> make organizations responsible for protecting it wherever it goes. You are obliged to inform customers their information <\/span>might<\/span><\/i> be managed and seen by others in other countries, and you must protect it just as well as if it stayed within Canada. <\/span>Office of the Privacy Commissioner<\/span><\/p>\n

That\u2019s not a contradiction \u2014 it\u2019s accountability.<\/span><\/p>\n

So Why Does This Matter for Interpretation Services?<\/b><\/p>\n

Let\u2019s say a health clinic, emergency line, or legal office uses a language provider that has call centres or interpreters based outside Canada. Your client\u2019s personal information \u2014 names, medical details, legal issues \u2014 may be touching systems in multiple countries. That\u2019s okay under PIPEDA <\/span>if<\/span><\/i> you\u2019ve been transparent with customers and can guarantee comparable protections. <\/span>Office of the Privacy Commissioner<\/span><\/p>\n

But that\u2019s exactly the point: do you ask, <\/span>have you asked, are you truly being vigilant in our current threat actor environment?<\/b><\/p>\n

Three Questions That Should Be Easy to Answer<\/b><\/p>\n

  2. Are interpretation calls ever routed outside Canada? If yes, where?<\/span><\/li>\n
  3. What safeguards are in place to protect that data no matter where it is transmitted?<\/span><\/li>\n<\/ol>\n
